Royal Institution of Chartered Surveyors (RICS)

Our RICS Valuation Expert Witness Services professionals have a thorough understanding of real estate markets, appraisal methods, and the legal process and are able to provide an unbiased, independent, and objective opinion on the value of real estate assets, including commercial and residential properties, and personal properties such as plant and machinery.

EDS’ RICS valuation expert witnesses are often called upon to provide expert testimony in legal proceedings such as:

  • Property disputes (e.g., boundary disputes, rights of way, condemnation, and easements)
  • Litigation involving property valuations (e.g., matrimonial disputes and probate valuations)
  • Professional negligence claims against surveyors or valuers
  • Arbitration or mediation involving real estate or  personal property disputes
  • Taxation and rating matters
  • Compulsory purchase and compensation claims

RICS expert witnesses must comply with the RICS Red Book (International Valuation Standards) that provides the RICS guidance on the professional standards of valuers.

EDS provides comprehensive RICS valuation expert-witness testimony and litigation-support services in all disciplines of appraisal, e.g., Real Estate, Business Valuation, Intellectual Property, Personal Property, Machinery and Equipment, Business Income, Probate, and Economic Damages.

Our discipline-specific and multidisciplinary RICS valuation expert-witness testimony and litigation-support providers are internationally accredited ASA/MAI/RICS valuation instructors—all well-published luminaries in the global valuation community. Our RICS valuation experts include Uniform Standards of Professional Appraisal Practice (USPAP) and International Valuation Standards (IVS) and RICS ‘Red Book’ instructors, Value Adjustment Board (VAB) Magistrates, and former state/federal appraisal regulatory compliance officers.

We conduct in-depth valuation analyses and provide objective opinions and advice that help resolve complex appraisal and valuation issues. We advise client counsel in the preparation of valuation-related discovery, Daubert challenges, and appraisal/appraiser compliance with state and federal regulations, USPAP, IVS-Red Book, and international Basel Accords.

EDS specializes in handling complex multidisciplinary and multi-jurisdictional RICS valuation matters. For example, a dispute wherein multiple domestic and international locations/jurisdictions and multiple valuation disciplines are at issue, e.g., Real Property, Business Valuation, and Machinery and Equipment. Unlike others, EDS will assign one of its internationally accredited RICS valuation experts from each valuation discipline at issue possessing the requisite jurisdictional and geographic competency to contribute to the process. This ensures credible findings that will withstand challenges and scrutiny from regulatory, judicial, and taxing authorities.
